About the decision of the Moscow Arbitration Court

The rulling of the Moscow Arbitration Court dated March 20, 2024 was received on the case of challenging the Yakutsk Airport JSC final report of the Interstate Aviation Committee (IAC) Commission prepared on the basis of the results of the accident investigation involving RRJ-95 (RRJ-95B model) RA-89011 aircraft owned by Yakutia Airlines JSC, according to which the applicant's arguments were determined to be unsubstantiated, and the case was declared subject to termination.

"This court decision further confirms the established judicial practice, indicating that the final report of the IAC commission cannot be the subject of judicial challenge, since it does not contain mandatory prescriptions and does not ristrict the rights and legitimate interests of the subjects of aviation activities, since aircraft accident investigations are conducted by IAC Commissions with the sole purpose of preventing aircraft accidents in the future," - noted Deputy Chairman of the IAC - Stats-Secretary Dmitry Kostennikov.

Recall that the indicated aircraft accident involving the RRJ-95B RA-89011 aircraft owned by Yakutia Airlines JSC occurred on October 10, 2018 at the Yakutsk Airport.
